  1. This file contains the licensing terms for ERS Internet ScreenSavers.

  3. By installing the software, you are consenting to be bound by this 
  4. License Agreement.  If you do not agree to all of the terms of this 
  5. License Agreement; please remove the software from your system.
  6.  
  7. INSTALLATION
  8. (On the Drive where you unzipped this download.)(Usually C:\)
  9.  
  10. At the desktop click on start, click on run, in the text window type:

  16. Follow the instructions.

  65. END USER AGREEMENT

  67. GRANT: ERS Internet Screensavers ("ERS") hereby grants you a limited, 
  68. nontransferable, terminable, non-exclusive license subject to the 
  69. following to use its accompanying computer software product known as the 
  70. ScreenSaver (including the 16-bit, 32-bit,"Software") for individual use 
  71. only on a Personal Computer described below.  You may place the Software 
  72. on networks and online systems exclusively for the purpose of allowing 
  73. downloading and copying of the Software for archival, distribution and 
  74. installation purposes (but not for purposes of execution by the network 
  75. or online system) provided any such copy must contain all of the original 
  76. Software and text files including this License Agreement and any proprietary, 
  77. license and copyright notices on the original.  
  78.  
  79. You may use the Software only on a single user Personal Computer that: 
  80. (a) has one Intel 386, 486 or Pentium processor,Cyrix processor, AMD processor, 
  81. Motorola 68036 or 68040 processor or IBM Power PC processor;  (b) operates 
  82. only the Microsoft DOS and Windows operating system (c) contains at least 
  83. 4 megabytes of random access memory; (d) contains 80 megabytes of internal hard 
  84. disk storage; (e) contains a keyboard (not an infrared remote) and monitor 
  85. (not a television set); (f) is able to produce printed output on a local 
  86. printer; and (g) does not act as a server on any network (including a local 
  87. area network, wide area network or Internet) or otherwise allow operation of 
  88. the Software from a remote or separate computer or terminal ("Personal Computer").  
  89. For the avoidance of doubt, and without limitation of the foregoing, "Personal 
  90. Computer" does not include game players, television set-top boxes or so-
  91. called "Internet Appliances".

  93. You may not permit other individuals to use, operate or copy the 
  94. Software (except as permitted above).  You may not use or allow the use 
  95. of the Software on any computer or other device that is not a Personal 
  96. Computer (as defined above).  You may not modify, translate, reverse 
  97. engineer, decompile, disassemble, (except to the extent applicable laws 
  98. prohibit such restriction), or create derivative works based on the 
  99. Software, copy the Software (except as specified above), rent, lease, 
  100. transfer, license or otherwise transfer rights to the Software, or 
  101. remove any proprietary notices, licenses, displays, installation 
  102. procedures or labels on or in the Software, whether set forth in text 
  103. files or on media.

  105. DISCLAIMER OF WARRANTY: THE SOFTWARE IS LICENSED ON AN AS-IS BASIS, 
  106. WITHOUT WARRANTY OR CONDITION OF ANY KIND AND ERS DISCLAIMS ALL 
  107. WARRANTIES AND CONDITIONS, INCLUDING WITHOUT LIMITATION THE IMPLIED 
  108. WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND 
  109. NON-INFRINGEMENT.  The entire risk as to the quality and performance of 
  110. the Software is borne by you.  Should the Software prove defective, you 
  111. and not ERS assume the entire cost of any service and repair.  This 
  112. Disclaimer of Warranty constitutes an essential part of the License 
  113. Agreement.  SOME STATES DO NOT ALLOW EXCLUSIONS OF AN IMPLIED WARRANTY, 
  114. SO THIS DISCLAIMER MAY NOT APPLY TO YOU AND YOU MAY HAVE OTHER LEGAL 
  115. RIGHTS THAT VARY FROM STATE TO STATE OR BY JURISDICTION.

  117. LIMITATION OF LIABILITY: UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL 
  118. THEORY, WHETHER TORT, CONTRACT, OR OTHERWISE, SHALL ERS OR ITS 
  119. SUPPLIERS, LICENSORS OR RESELLERS BE LIABLE TO YOU OR ANY OTHER PERSON 
  120. FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY 
  121. TYPE INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK 
  122. STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, LOSS OF DATA, OR ANY AND ALL 
  123. OTHER COMMERCIAL DAMAGES OR LOSSES.  IN NO EVENT WILL ERS BE LIABLE 
  124. FOR ANY DAMAGES IN EXCESS OF ERS'S LIST PRICE LICENSEE FEE FOR THE 
  125. SOFTWARE, IF ANY, EVEN IF ERS SHALL HAVE BEEN INFORMED OF THE 
  126. POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY.  SOME 
  127. STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR 
  128. CONSEQUENTIAL DAMAGES, SO THIS LIMITATION AND EXCLUSION MAY NOT APPLY TO 
  129. YOU.

  131. TITLE:    Title, ownership rights, and intellectual property rights in 
  132. and to the Software shall remain in ERS and/or its licensors or 
  133. suppliers.  The Software is protected by copyright laws of the United 
  134. States and international copyright treaties.  You are permitted to use 
  135. only one copy of the Software, even if you receive multiple copies, 
  136. whether via download or on magnetic media.  Title, ownership rights, and 
  137. intellectual property rights in and to the content accessed through the 
  138. Software is the property of the applicable content owner, and may be 
  139. protected by copyright or other applicable law.  This License gives you 
  140. no rights to such content.

  142. TERMINATION:    This License will terminate automatically if you fail to 
  143. comply with the limitations described above.  On termination, you must 
  144. destroy all copies of the Software and documentation.
  145.  
  146. MISCELLANEOUS:   This Agreement represents the complete agreement 
  147. concerning this license between the parties and supersedes all prior 
  148. agreements and representations  between the parties.  This  Agreement 
  149. may be amended only by a writing executed by both parties.  THE 
  150. ACCEPTANCE OF ANY PURCHASE ORDER PLACED BY YOU IS EXPRESSLY MADE 
  151. CONDITIONAL  ON YOUR ASSENT TO THE TERMS SET FORTH HEREIN, AND NOT THOSE 
  152. CONTAINED IN YOUR PURCHASE ORDER.  If any provision of this Agreement is 
  153. held to be unenforceable for any reason, such provision shall be 
  154. reformed only to the extent  necessary to make it enforceable.  This 
  155. Agreement shall be governed by and construed under Louisiana substantive 
  156. law as such applies to agreements between Louisiana residents entered into 
  157. and performed within Louisiana, except as governed by United States 
  158. Federal law.  You consent to the jurisdiction of the state and federal 
  159. courts in the State of Louisiana
